Awami Dar al-Islam and Dar al-Kufr are a Legitimate Rule

and a Fixed Jurisprudential and Political Concept Far from Dar al-Ifta’s Fables
(Translated)

A new chapter of the fierce onslaught on Islam and Muslims after the West realized that Muslims have a specific awareness of a specific political Islam as a way of life, which is what US Secretary of State Pompeo, said: “The threat to America” was caused by “people who deeply believe that Islam is the way.” Here is Dar al-Ifta on its website, after it denied a fixed legitimate ruling which is the concept of Dar al-Islam (Land of Islam) and Dar al-Kufr (Land of disbelief), it comes up with fables which we do not know where they extracted them from, and a new concept that we did not know in jurisprudence and politics, which is the concept of Dar (Land) of tolerance, love and brotherhood! And we do not know which tolerance and love they talk about, in the context of modern international relations and covenants, while people, especially Muslims, are killed in cold blood to plunder their wealth and their resources to force them to leave their religion. Examples are many, from Ash-Sham, Yemen and Libya where the international conflict, to Burma and the slaughter of Muslims there, and China and as is with the Uighurs Muslims in East Turkistan and its arrest of millions of them just because they are Muslims…

The Shari’i concepts are in fact provisions that are not interpreted by international covenants and relations, but are interpreted by the divine evidence from which they were derived. The Shar’i has divided the land into two types: Dar al-Islam and Dar al-Kufr, and showed that Dar al-Islam, is the land which is governed by the laws of Islam and whose security (Aman) is maintained by the security of Islam, even if the majority of its inhabitants are non-Muslims. Dar al-Kufr is the land which is governed by the laws of Kufr, and whose security is not maintained by the security (Aman) of Islam, even if the majority of its inhabitants are Muslims, so what matters in determining whether the land is Dar al-Islam or Dar al-Kufr is the applied laws and systems. No one of the earlier or later scholars of the Ummah has disagreed with this. This is what was stated by the Prophet (saw) when he appoints anyone as leader of an army or detachment, where he would instruct him and say:

«ثُمَّ ادْعُهُمْ إِلَى التَّحَوُّلِ مِنْ دَارِهِمْ إِلَى دَارِ الْمُهَاجِرِينَ وَأَخْبِرْهُمْ أَنَّهُمْ إِنْ فَعَلُوا ذَلِكَ فَلَهُمْ مَا لِلْمُهَاجِرِينَ وَعَلَيْهِمْ مَا عَلَى الْمُهَاجِرِينَ فَإِنْ أَبَوْا أَنْ يَتَحَوَّلُوا مِنْهَا فَأَخْبِرْهُمْ أَنَّهُمْ يَكُونُونَ كَأَعْرَابِ الْمُسْلِمِينَ يَجْرِي عَلَيْهِمْ حُكْمُ اللَّهِ الَّذِي يَجْرِي عَلَى الْمُؤْمِنِينَ وَلَا يَكُونُ لَهُمْ فِي الْغَنِيمَةِ وَالْفَيْءِ شَيْءٌ إِلَّا أَنْ يُجَاهِدُوا مَعَ الْمُسْلِمِينَ»

“…then invite them to migrate from their lands to the land of the Muhajireen and inform them that, if they do so, they shall have all the privileges and obligations of the Muhajireen. If they refuse to migrate, tell them that they will have the status of Bedouin Muslims and will be subjected to the Commands of Allah like other Muslims, but they will not get any share from the spoils of war or Fai’ except when they actually fight with the Muslims (against the disbelievers).”

So, where did you draw your definition of Dar of tolerance and love except from the fables of the United Nations and its international conventions that fight Islam and Muslims and work to prevent them from bringing back the state of their glory?!

The war on the concept of Dar al-Islam and Dar al-Kufr is a war against Islam, its system and its state, which is about to return. It is a war led by America and its tools from the door keeping rulers of our country.

And you in Dar al-Ifta, you chose but to be part of it, and part of that onslaught that rages against the Ummah and its Deen, and part of misleading it, rather the carriers of the brigade of misleading it in the name of Islam. How are you going to meet Allah (swt) and you are misleading the Ummah, turning it away from its Deen and taking the legitimate texts out of their context to justify the triviality of your words and the fables of your misguidance?! And above that you describe the workers for the application of Islam in its state as the transgressors and the Khawarij (rebellions)! As if your rulers who sold the country and the people and fought Allah and His Messenger are the guardians who rule by Islam?!! and in a clear fraud as if people do not see your claim that the Shariah is applied?! Where is the Shariah in a country that sanctifies the borders of Sykes-Picot and considers the Muslim outside its borders a foreigner, a country governed by the Western laws laid down by human beings?!

O People of Al-Kinanah!

The Sharia concepts are fixed legal provisions (Ahkam Shar’iah) derived from the extrapolation of the divine evidences, and those who want to deny them should come with a divine evidence and should not put forward to us the argument of time and place. The Shara’ law does not change with time and place, but each reality has its Hukm Shari’, and the reality itself is not a source of thinking and making judgment, rather it is the subject of thinking and the work for change. The war on the fixed concepts of Islam aims to distract you from the fact that Islam is a way of life which you should be living on its basis and the basis of its Aqeedah. This is what the West has realized and also comprehended that in the Ummah, men like Shabab of Hizb ut Tahrir who work in the Ummah so that Islam becomes its actual way of life in a state, which they are working to establish with you, and they only lack the people of power among you to support them to establish the state of glory of this Ummah; Khilafah Rashidah (righteous Caliphate) on the method of the Prophethood; a state that enrages Kufr and its people even before it exists. O Allah hasten it for us and make us of its soldiers and witnesses…

(يَا أَيُّهَا الَّذِينَ آمَنُواْ اسْتَجِيبُواْ لِلّهِ وَلِلرَّسُولِ إِذَا دَعَاكُم لِمَا يُحْيِيكُمْ وَاعْلَمُواْ أَنَّ اللّهَ يَحُولُ بَيْنَ الْمَرْءِ وَقَلْبِهِ وَأَنَّهُ إِلَيْهِ تُحْشَرُونَ)

“O you who have believed, respond to Allah and to the Messenger when he calls you to that which gives you life. And know that Allah intervenes between a man and his heart and that to Him you will be gathered” [Al-Anfal: 24].
