No Oh Daar-ul-Iftaa! Islam has indeed commanded a specific political system and this system is the Khilaafah and Islam has made everything other than it Haraam. So fear Allah!
The Egyptian Daaru-l-Iftaa has issued a Fatwaa permitting political pluralism and stating that Islam has not ordered the existence of a specific political system. This Fatwaa used as evidence (according to the statement of the Daaru-l-Iftaa) to support their claim, the methodology used to appoint the first, second and third Khulafaa where the Messenger of Allah صلى الله عليه وسلم did not make a statement in regards to the Khalifah who would come after him and then the Muslims went on to choose Abu Bakr (ra), then Abu Bakr came and appointed ‘Umar to be the Khalifah after him and then ‘Umar appointed six from which one would be appointed as the Khalifah.
The purpose of this Fatwaa is to mislead the people and deceive them and this is in order to ease the establishment of a secular civil state which is currently being marketed to the people of Egypt. And these attempts by America and her agents within the regime who are behind the likes of this Fatwaa are only attempts that are doomed to fail because verily Allah سبحانه وتعالى has promised the granting of authority in the land and its firm establishment:
وَعَدَ اللهُ الّذينَ آمَنوا مِنْكُمْ وَعَمِلوا الصّالِحاتِ لَيَسْتَخْلِفَنَّهُمْ في الأرْضِ كَمَا اسْتَخْلَفَ الّذينَ مِنْ قَبْلِهِمْ وَلَيُمَكِنَنّ لَهُمْ دينَهُمْ الذي ارتَضى لَهُمْ
“And Allah has promised those who believe and work righteous acts that he will surely grant them authority on the earth like he granted it to those who came before and he will surely firmly establish for them their Deen which he has chosen for them.” (An-Noor, 55)
And the Messenger of Allah صلى الله عليه وسلم also gave glad tidings of this when he said: “And then there will be a Khilaafah upon the path of the Prophethood, and then he remained silent.” (Ahmed)
Indeed the ruling system in Islaam which the Lord of all creation has made Fard is the Khilafah system. A system in which the Bay’ah is given to the Khalifah upon the Book of Allah and the Sunnah of his Messenger so as to rule by what Allah سبحانه وتعالى has revealed. The evidences for this in the Book, the Sunnah and the Ijmaa’ of the Sahaabah are many and extensive and we present from them the following as an example:
As for the Book of Allah then Allah سبحانه وتعالى says:
فاحْكُمْ بَينَهُمْ بِما أنْزَلَ اللهُ ولا تَتَّبِعْ أهْواءَهُمْ عَمّا جاءَكَ مِنَ الحَق
“So rule between them by (all) that Allah has revealed and do not follow their desires away from that which has come to you in truth”
وأنِ احْكُمْ بَينَهُمْ بِما أنْزَلَ اللهُ ولا تَتّبِعْ أهْواءَهُمْ واحذَرْهُمْ أنْ يَفْتِنوكَ عَنْ بَعْضِ مَا أنْزَلَ اللهُ إليْك
“And rule between them by what Allah has revealed and do not follow their desires and beware of them lest they seduce you away from some of what Allah has revealed to you.”
And from the Sunnah, the Messenger of Allah صلى الله عليه وسلم said: “Whoever releases his hand from obedience will meet Allah ‘Azza wa Jalla without having any proof for himself and whoever dies without a Ba’yah on his neck will die the death of Jaahiliyah (per-Islamic ignorance).” (Muslim)
He صلى الله عليه وسلم also said: “The children of Israa’eel were taken care of (in ruling) by the Prophets. Every time one perished another prophet would take his place however there will be no prophet after me and there will be Khulafaa’ and they will number many. They (the Sahaabah) asked: So what do you command us to do? He صلى الله عليه وسلم replied: Give the Bay’ah to them, to the first and then the first and give them their right because Allah will surely question them about what they were entrusted with.” (Muslim)
And from the Ijmaa’ of the Sahaabah, then all of them (rah) agreed upon the necessity of establishing a Khalifah (successor) to the Messenger of Allah صلى الله عليه وسلم after his death and they agreed to the appointment of Abu Bakr as the Khalifah, then ‘Umar and then ‘Uthmaan after the death of each one of them.
The shape of ruling in Islam is the Khilafah, it is a system that is distinguished from the well known systems of ruling present in the world today and this is the same whether it is looked at from the perspective of the basis upon which it is established , or its thoughts, concepts and criterions or the legislations which are used to look after the affairs, or in regards to the constitution and canons that are placed down to be applied and implemented or even in terms of the shape of the Islamic State which is unique and distinguished in comparison to all other shapes of ruling in the entire world. So it is neither a monarchical system of ruling and it does not agree with it, it is not an imperial system nor is it a system of federation where its regions are divided into units of self-independence whilst the ruling is united just as it is not a republican system which was founded as a reaction to the tyranny of the monarchical systems.
And it is not a democratic system in terms of the true meaning of democracy where the legislation belongs to the people and they then decide what is Halaal and what is Haraam and what is good and bad or in terms of not being restricted by the Sharee’ah rules in the name of freedoms. The disbelievers have realised that the Muslims will not accept democracy with its true meaning and as such the disbelieving colonial nations (and in particular America today) have attempted to market it in the Muslim lands and bringing it to them by way of deception by saying that democracy is merely a tool for electing the ruler and you see them playing with the emotions of the Muslims with it as if the the main issue in democracy was the election of a ruler exploiting the fact that the Muslim lands are full to the brim with oppression, suppression, silencing of speech and dictatorships.
As for the institutions of the Khilafah State in terms of ruling and administration then according to what the Sharee’ah evidences have explained they are:
1. The Khalifah.
2. Mu’aawinoon At-Tafweed (delegated assistants).
3. Mu’aawinoon At-Tanfeedh (executive assistants).
4. The Wulaa (Governors).
5. The Ameer of Jihaad.
6. The department of internal security.
7. The department of foreign affairs.
8. The department of industry.
9. The Judiciary.
10. The department of peoples affairs.
11. The Bayt-ul-Maal (The State treasury).
12. The department of Information (I’laam)
13. The Ummah’s council (Shooraa and Accounting).
This is the political system which Islam has specified and made obligatory to establish so as to implement the rules of Allah through it and it alone. And it alone is the system that will solve the problems of Egypt in all issues of life, these same problems that originated from the democratic capitalist system causing incurable crises in Egypt and the world and which has been completely unable to solve them. And by the permission of Allah, America and her agents will never succeed with the regime and its mouthpieces to market to us a civil secular democratic liberal state with a (so called) Islamic point of reference!
As for the method in which the four rightly guided Khulafaa were chosen then this defines the manner of by which each was appointed and it does not reflect political plurality. The four Khulafaa were all rightly guided Khulafaa and they all implemented the Sharee’ah completely and immediately without gradualism. Not one of them implemented a political system according to their desires or the desires of the majority of the people but rather they implemented the political system which had been made obligatory upon them and this is the Khilafah system and none other. This is not political pluralism and it is not permissible in Islam for parties based on other than the Islamic belief to participate in the political ruling system according as Allah سبحانه وتعالى states:
أفَحَكُم الجاهليةِ يَبْغون
“Are you then seeking other than the Hukm (ruling) of Allah”
He سبحانه وتعالى says:
إنِ الحكمُ إلّا لِله
“Indeed the ruling is for none but Allah”
Hizb-ut-Tahrir has explained the details of the Khilafah system along with its Sharee’ah evidences in the book: ‘The institutions of the Khilafah state’ and volumes one and two of the book: ‘Introduction of the constitution and its reasoning’ in addition to the other books which the Hizb issued.
إِنَّ الَّذِينَ يَكْتُمُونَ مَا أَنْزَلْنَا مِنَ الْبَيِّنَاتِ وَالْهُدَى مِنْ بَعْدِ مَا بَيَّنَّاهُ لِلنَّاسِ فِي الْكِتَابِ أُولَئِكَ يَلْعَنُهُمُ اللَّهُ وَيَلْعَنُهُمُ اللَّاعِنُونَ
“Verily, those who conceal the clear proofs, evidence and the guidance, which We have sent down, after We have made it clear for the people in the Book, they are the ones cursed by Allah and cursed by the cursers.”
