Islamabad High Court is providing legal cover to abductions and torture by government agencies

Court refused to act against government agencies on providing false affidavits and illegal abductions

Chief justice Islamabad High Court, Iqbal Hameed ur Rehman has showed his loyalty with the government agencies by disposing off the writ petition of two abducted members of Hizb ut-Tahrir without taking any legal action. A Member of Hizb registered his statement before a magistrate in which he named ISI and MI as the abductors. But instead of taking action against them Chief Justice simply disposed off the writ. Lawyer of the Hizb’s attorney reminded the court that agencies in their written affidavit denied the custody of these members, which has been proven false in the light of new evidences so a legal action must be initiated against them. But the Chief justice ignored it by simply saying that let’s put it aside because detainees have been released.  This statement of the judge is not only legally shameful but it has also given an open license to the agencies to continue their criminal acts. Did the judge not remember that until today an elderly member of Hizb, Dr. Abdul Qayyum, is still being tortured in their dungeons? So how can one spare these agencies? The question is why in the world judge did not put any pressure on the agencies to immediately release Dr. Abdul Qayyum? Is this mercy on behalf of abductors to release the detainees after torturing them for three months whilst the thankful judiciary doesn’t even care to account them?!  Is this the purpose of judiciary to give lengthy hearing dates in order to provide ample time for the agencies to torture Hizb members? And when evidence are presented before the court, it simply takes no action? There is no doubt about the fact that an unholy nexus of agencies, police and judiciary under the shade of imperialists and their agent rulers is a major source of persecution in Pakistan. In fact, today every institution of this kufr system is equally responsible for the implementation of kufr, resisting Islam and the persecution of Muslims. During the movement of so-called Freedom of Judiciary, Hizb ut-Tahrir had warned the Ummah  that merely an independent judge in a Kufr judicial system – a legacy of the British Raj, can never provide justice because the laws according to which the judge has to pass his judgment are themselves corrupt and a source of oppression. Even today, judiciary is one of the most important tools in the hands of the imperialists to protect this kufr system and stop the emergence of Islam.

Hizb ut-Tahrir demands from conscientious people within the lawyer community as well as the human rights organizations that they should raise their voices against this ‘institutional persecution’ and join their hands with Hizb ut-Tahrir to rein in the agencies and recover Dr. Abdul Qayyum. The day is not far when institutionalized persecution will be brought to an end through the establishment of the Khilafah and all those would be brought to justice who have committed crimes against the carriers of Islam.

اسلام آباد ہائی کورٹ حکومتی ایجنسیوں کو اغوا اور ٹارچر جاری رکھنے کے لئے قانونی تحفظ فراہم کر رہا ہے
عدالت نے حکومتی ایجنسیوں کے جھوٹے بیان اور اغوا کے خلاف کاروائی کرنے سے انکار کر دیا

اسلام آباد ہائی کورٹ کے چیف جسٹس اقبال حمید الرحمن نے ایجنسیوں سے وفاداری کا ثبوت دیتے ہوئے حزب التحریر کے دو اراکین کی رِٹ بغیر کسی کاروائی کے نمٹا دی۔ واضح رہے کہ ایجنسیوں کی حراست سے رہائی پانے والے حزب کے ممبر نے مجسٹریٹ کے سامنے اپنے حلفیہ بیان میں اغوا کی ذمہ داری آئی ایس آئی اور ایم آئی پر ڈالی تھی۔ لیکن چیف جسٹس نے ان کے خلاف کاروائی کا اعلان کرنے کے بجائے رِٹ خارج کر دی۔ حزب کے وکیل نے عدالت کی توجہ اس امر پر بھی مبذول کروائی کہ یہ ایجنسیاں اپنے تحریری بیان میں اس حقیقت کا انکار کرچکی ہیں کہ یہ ممبران ان کی تحویل میں تھے، جبکہ شواہد آنے کے بعد ثابت ہو گیا ہے کہ ایجنسیوں کا یہ بیان سراسر غلط بیانی اور دھوکے پر مبنی تھا۔ لہذا ان کے خلاف قانونی چارہ جوئی کی جائے جس پر چیف جسٹس نے یہ کہہ کر ان کی بات نظر انداز کر دی کہ اس بات کو چھوڑیں اب گمشدہ افراد واپس آ گئے ہیں۔ جج کا یہ بیان نہ صرف قانونی لحاظ سے شرمناک ہے بلکہ یہ حکومتی غنڈہ گردی جاری رکھنے کے لئے ایجنسیوں کو کھلا لائسنس مہیا کرنا ہے۔ کیا ’’فاضل‘‘ جج کو یہ یاد نہیں رہا کہ آج بھی حزب کے بزرگ رکن جناب ڈاکٹر عبدالقیوم ایجنسیوں کی عقوبت خانوں میں ظلم کی چکی میں پس رہے ہیں ایسے میں ان ایجنسیوں کو کیسے چھوڑا جاسکتا ہے؟ آخر کیا وجہ ہے کہ جج نے ان ایجنسیوں پر دباؤ نہیں ڈالا کہ ڈاکٹر صاحب کو فی الفور رہا کیا جائے؟ کیا اغوا کار کا یہی احسان ہوتا ہے کہ وہ تین ماہ شدید ٹارچر کے بعد مغوی افراد کو چھوڑ دے جبکہ عدلیہ اس ظلم پر ان سے کوئی بازپرس تک نہ کرے؟ کیا عدلیہ کا کام محض یہی ہے کہ وہ پیشی کی لمبی تاریخیں دے کر ان حکومتی غنڈوں کو ٹارچر کرنے میں مدد فراہم کرے اور جب ان کے خلاف شواہد آجائیں تو انہیں بغیر کاروائی کے چھوڑ دیا جائے؟! بے شک استعمار اور ایجنٹ حکمرانوں کی سرپرستی میں ایجنسیوں، پولیس اور عدلیہ کا گٹھ جوڑ پاکستان میں ظلم و جبر کا بدترین منبع ہے۔ بے شک آج کفریہ نظام کا ہر ادارہ کفر کے نفاذ، اسلام دشمنی اور مسلمانوں پر ظلم کرنے میں برابر کا شریک ہے۔ عدلیہ کی ’’آزادی‘‘ کے مہم کے دوران بھی حزب التحریر نے امت کو متنبہ کیا تھا کہ انگریز کے چھوڑے کفریہ نظام کو نافذ کرنے والا ’’آزاد‘‘ جج کبھی بھی انصاف فراہم نہیں کر سکتا کیونکہ وہ جس قانون کے تحت فیصلہ کرتا ہے وہ قانون بذات خود ظلم پر مبنی ہوتاہے۔ آج بھی یہ عدلیہ اسلام کے نفاذ اور کفر کے نظام کی تحفظ میں استعمار کا بہت بڑا ہتھیار ہے۔

حزب التحریر وکلاء برادری اور انسانی حقوق کی تنظیموں سے موجود باضمیر افراد سے مطالبہ کرتی ہے کہ وہ اس ’قانونی ظلم‘ کے خلاف آواز بلند کریں اور ان ایجنسیوں کو لگام دینے اور ڈاکٹر عبد القیوم کی رہائی کے لئے حزب التحریر کی جدوجہد میں اپنا حصہ ڈالیں۔ وہ دن دور نہیں جب خلافت کے قیام کے ذریعے اس (institutional)انسٹی ٹیوشنل ظلم کا خاتمہ کیا جائیگا اور اسلام کے داعیوں پر ظلم کرنے والوں کو کیفر کردار تک پہنچایا جائیگا۔
