Only the Khilafah’s Islamic Judiciary Will Give Blasphemy its Due Weight

Pakistan has erupted in protest at the regime’s 29 February hanging of Mumtaz Qadri, an Elite Force commando convicted of killing former Punjab governor Salman Taseer. In a 40-page statement submitted to the court before his execution, Qadri had stated that Taseer’s statements in support of Asia Bibi, a Christian woman charged with blasphemy, and calling the blasphemy law a “black law” that had provoked him to kill the governor.

The hanging of Mumtaz Qadri is in origin because of the absence of an Islamic judiciary and Khilafah in Pakistan. In Islam, it is upon the judiciary to account all the rulers, including the Khaleefah himself, over their implementation of Islam. Yet, the current judiciary took no action whatsoever against Salman Taseer, a ruler at the time, for his well-publicized, repeated statements over the blasphemy law, which evidently provoked strong religious sentiments and opposition. The secular judiciary did not take the law into its hands over suspected blasphemy, playing the role of a stone statue, moving only to convict Qadri for taking the law into his own hands. It did not seek clarification over the statements of Salman Taseer as soon as he made them, yet saw fit to execute Qadri for taking action on unverified statements. This is no surprise because the current secular judiciary is based on the detachment of religion from life, so blasphemy has no real weight. The current judiciary has nothing whatsoever to do with Allah (swt) and His Messenger (saaw) or the deeply-seated Islamic sentiments of the people. Its primary function is to imitate the Western secular system, which openly and repeatedly allows the ridicule and insult of Esa (as) and Muhammad (saaw). It is no more than a vestige of the virulently anti-Islam, British Raj occupation and so cannot be Islamized or reformed, rather it must be uprooted by the establishment of the Khilafah and replaced by Islam’s judiciary.

As for the current rulers, their only preoccupation is earning the praise of their Western masters and the Islamic sentiments and values mean nothing for them. They themselves went around the judiciary by establishing military courts to forcibly suppress those who engage in Jihad against the American occupation in Afghanistan or the Indian occupation of Kashmir. They themselves established a “National Action Plan” to forcibly curb the call for Islam and its Khilafah, making a mockery of judicial process, employing abduction and torture against Ulema and advocates for the Khilafah. And it did not escape our notice that the regime timed the hanging for the benefit of its masters as well, at a critical time when the West is using a selective ceasefire to unleash brutal aggression against the sincere Muslims of Syria who seek to re-establish the Khilafah (Caliphate) on the Method of the Prophethood and at a time the regime was under fire for seeking to send our forces in defense of the Syrian tyrant Bashar.

Only the Khilafah is the protective shield and the real fortress of Islam. Only its return will ensure the protection of the honor of RasulAllah (saaw) within the Muslim Lands and well-outside the Muslim Lands. We must remember today that in the late nineteenth century, namely in the year 1890 CE, an incident happened when a French writer produced a play to be shown in a French comedy theater and the play was containing an abuse to the Messenger of Allah (saw). As soon as the Khaleefah Abd al-Hameed II (rh.a) knew that such a play was to be shown, he asked France to ban the release and presentation of the play, not only on the Francis theater but on all other theaters of France. So, France complied and took the decision accordingly and sent a letter to the Turkish Sultan (Khaleefah) stating: “We are confident that this decision, we have taken in response to the wishes of your Excellency the Sultan, will enhance our cordial relations…”, and when the playwright (dramatist) tried to exhibit the play in England and made preparation to show it in a prominent theatre, as soon as Sultan Abd al-Hamid got wind of it, he called for its ban and so it was banned. In addition, England who was the superpower at that time apologized for the preparation which was being made for exhibition of the play… and that’s prior to its public show!

We must all pledge ourselves to re-establish the Khilafah so that there can never again be such neglect of the issue of blasphemy. RasulAllah صلى الله عليه و سلم said,

وَإِنَّمَا الْإِمَامُ جُنَّةٌ يُقَاتَلُ مِنْ وَرَائِهِ وَيُتَّقَى بِهِ

“The Imam is a shield, fighting is under his leadership and protection is by him.”

صرف خلافت کی اسلامی عدلیہ ہی توہین رسالت کے مسئلے کو اہمیت دے گی

29 فروری بروز پیر پاکستان بھر میں حکومت کے ہاتھوں ممتاز قادری کی پھانسی کے خلاف مظاہرے شروع ہوگئے ۔ ممتاز قادری کا تعلق پولیس کی ایلیٹ کمانڈو فورس سے تھا جس نے پنجاب کے سابق گورنر سلمان تاثیر کو قتل کردیا تھا۔ عدالت کے سامنے اپنے چالیس صفحات پر مشتمل بیان میں قادری نے یہ کہا تھا کہ سابق گورنر کی جانب سے توہین رسالت کی ملزمہ ایک عیسائی خاتون آسیہ بی بی کی حمایت اور توہین رسالت کے قانون کو “کالا قانون” قرار دینے کے بیانات نے اسے مشتعل کردیا تھا جس کی بنا پر اس نے سابق گورنر کو قتل کیا تھا۔

ممتاز قادری کی پھانسی کی بنیادی وجہ پاکستان میں خلافت اور اسلامی عدلیہ کی غیر موجودگی ہے۔ اسلام میں عدلیہ کی یہ ذمہ داری ہوتی ہے کہ وہ حکمرانوں کا احتساب کرتی ہے جس میں خلیفہ بھی شامل ہوتا ہے کہ آیا وہ اسلام نافذ کررہے ہیں۔ لیکن موجودہ عدلیہ نے سلمان تاثیر، جو کہ ایک وقت حکمران بھی تھا، کے ان بیانات کا کوئی نوٹس نہیں لیا جب اس نے مسلسل توہین رسالت کے قانون کو نشانہ بنایا اور ان بیانات نے لوگوں کے مذہبی جذبات کو نہ صرف بھڑکایا بلکہ خود اس کے خلاف بھی لوگوں کا ردعمل سامنے آنا شروع ہوگیا۔ سیکولر عدلیہ نے اس وقت قانون کو اپنے ہاتھ میں نہیں لیا جب مبینہ طور پر سلمان تاثیر کے بیانات توہین رسالت کا باعث بن رہے تھے بلکہ اس وقت یہ سیکولر عدلیہ بُت بنی بیٹھی رہی، لیکن قادری کے خلاف حرکت میں آگئی کہ اس نے قانون کو اپنے ہاتھ میں لیا۔ اس سیکولر عدلیہ نے سلمان تاثیر سے اس کے بیانات پر وضاحت نہیں مانگی جب وہ مسلسل توہین رسالت کے قانون کے خلاف بیانات دے رہا تھا لیکن قادری کو پھانسی کی سزا دے دی کہ اس نے غیر ثابت شدہ بیانات پر یہ حرکت کی ہے۔ سیکولر عدلیہ کا یہ کردار باعث حیرت نہیں کیونکہ موجودہ عدلیہ کی بنیاد دین کی دنیا سے جدائی کے سیکولر تصور پر قائم ہے، لہٰذا توہین رسالت کوئی بڑا معاملہ نہیں۔ موجودہ عدلیہ کا اللہ سبحانہ و تعالیٰ، اس کے رسول ﷺ اور لوگوں کے اسلامی جذبات سے کوئی تعلق نہیں ہے۔ اس عدلیہ کا بنیادی کام مغربی سیکولر نظام کی نقالی کرنا ہے جو کھلے عام اور بار بار حضرت عیسیٰ علیہ اسلام اور محمدﷺ کی توہین کرنے کی اجازت دیتا ہے۔ یہ اسلام مخالف قابض برطانوی استعمار کی نشانی ہے اور اسی لیے اس کو نہ تو اسلامی بنایا جاسکتا ہے اور نہ ہی اس میں اصلاحات کی جاسکتی ہیں بلکہ ضروری ہے کہ اس نظام کو اکھاڑ کر خلافت قائم کی جائے جو اس کی جگہ اسلامی عدلیہ قائم کرے گی۔

جہاں تک موجودہ حکمرانوں کا تعلق ہے تو انہیں صرف اس بات کی فکر لاحق رہتی ہے کہ ان کے مغربی آقا ان سے خوش رہیں جبکہ اسلامی اقدار اور جذبات ان کے لئے کوئی اہمیت نہیں رکھتے۔ یہ حکمران خود اس عدلیہ کی کوئی عزت نہیں کرتے اور فوجی عدالتیں قائم کرتے ہیں تا کہ جو لوگ افغانستان میں امریکہ اور کشمیر میں بھارتی قبضے کے خلاف جہاد کررہے ہیں ان کو سزا دی جاسکے۔ ان حکمرانوں نے “نیشنل ایکشن پلان” بنایا تا کہ قوت کے ذریعے اسلام اور خلافت کی پکار کو دبایا جائے اور اس مقصد کے حصول کے لئے اغوا اور تشدد کے حربے علماء اور خلافت کے داعیوں کے خلاف استعمال کررہے ہیں اور ان کا یہ عمل اس عدلیہ کا مذاق اڑانے کی مترادف ہے۔ یہاں یہ بات بھی اہم ہے کہ حکومت نے اپنے آقاوں کے فائدے کے لئے پھانسی کی سزا پر عمل درآمد کے لئے اس وقت کا انتخاب کیا جب مغرب نام نہاد جنگ بندی کے ذریعے شام کے ان مسلمانوں کے خلاف زبردست حملے کررہا ہے جو نبوت کے طریقے پر خلافت کے قیام کی جدوجہد کررہے ہیں اور یہ وہ وقت ہے جب حکومت پر بہت زیادہ دباؤ ہے کہ وہ شام کے جابر بشار کو بچانے کے لئے افواج کو بھیجنے کی کوشش کیوں کررہی ہے۔

صرف خلافت ہی اسلام کی ڈھال اور اس کا قلع ہے جو اس کی حفاظت کرتی ہے۔ خلافت کی واپسی ہی اس بات کو یقینی بنائے گی کہ نہ صرف مسلمانوں کی سر زمین پر بلکہ اس سے باہر بھی رسول اللہﷺ کی کوئی توہین کرنے کی ہمت نہ کرے۔ ہمیں یاد کرنا چاہیے وہ وقت جب انیسوی صدی کے آخر میں، یعنی 1890 عیسوی میں، جب ایک فرانسیسی ڈرامہ نگار نے ایک ڈرامہ تخلیق کیا جسے فرانس کے مذاحیہ تھیٹر میں دیکھایا جانا تھا اور یہ ڈرامہ رسول اللہﷺ کی توہین پر مبنی تھا۔ جیسے ہی خلیفہ عبدلالحمید دوئم ؒ کو اس کے متعلق آگاہی حاصل ہوئی تو اس نے فرانس سے مطالبہ کیا کہ اس کو پیش کرنے پر پورے فرانس میں پابندی عائد کی جائے۔ لہٰذا فرانس نے خلیفہ کا یہ مطالبہ پورا کیا اور خلیفہ کو خط لکھا کہ،”ہمیں اعتماد ہے کہ یہ فیصلہ، جو ہم نے آپ کے مطالبے پر لیا ہے، اس کے ذریعے ہمارے اچھے تعلقات میں مزید اضافہ ہوگا”۔ اور جب ڈرامہ نگار نے یہ ڈرامہ برطانیہ کے ایک مشہور تھیٹرمیں چلانے کی کوشش کی اور سلطان کو اس کی خبر ہوئی تو اس نے اس پر پابندی کا مطالبہ کیا اور پابندی عائد ہو گئی۔ اس کے علاوہ برطانیہ ،جو اس وقت دنیا کی سپر پاور تھا، نے اس ڈرامے کو پیش کرنے کی کوشش پر معذرت بھی کی۔

ہم سب کو چاہیے کہ ہم اس بات کا عہد کریں کہ ہم خلافت کو قائم کریں گے تا کہ پھر توہین رسالت کے اہم ترین مسئلے پر کسی قسم کی غفلت کا مظاہرہ نہ ہوسکے۔ رسول اللہﷺ نے فرمایا کہ،

وَإِنَّمَا الْإِمَامُ جُنَّةٌ يُقَاتَلُ مِنْ وَرَائِهِ وَيُتَّقَى بِهِ

“بے شک امام (خلیفہ) ہی ڈھال ہے جس کے پیچھے رہ کر لڑا جاتا ہے اور اسی کے ذریعےتحفظ حاصل ہوتا ہے”(مسلم) ۔
