The Shahzaib Murder Case Verdict is Confirmation of the Failure of Pakistan’s Judiciary.

The Khilafah’s Shariah Judiciary is the Only Solution

 

On October 18, a three-member bench of the Supreme Court acquitted the accused Shahrukh Jatoi, of murder in the notorious Shahzeb murder case. Although this verdict sparked public condemnation, it was not unexpected. In dozens of previous verdicts, including the Nazim Jokhi, Raymond Davis, Abdul Majeed Achakzai cases, courts have given colonialists and other powerful people a way to escape through various legal loopholes. The Shahzeb murder case has again established that the system has collapsed. The state of Pakistan has become a state to serve the elite, in which the common man has no stake. It is time to replace the collapsed system with a Khilafah (Caliphate), built on the strong foundation of Islam!

 

In the Shahzeb murder case, the entire state machinery was involved in saving the accused, at every stage. Obstructing the registration of the case, not arresting the accused, transferring him out of the country, turning the jail into a five-star hotel, providing luxurious facilities in the hospital, forcing consents and then, on the basis of terrorism provisions, initially rejecting consent only to then accept, through the Supreme Court. It is clear that every level, Pakistan’s judiciary has collapsed. A three-stage judicial appeal system gives powerful people the time, space and convenience to subvert justice. Through the appeals system, death sentences are first commuted to life imprisonment, before acquittal, as happened in this case. The long period of ten years provides an opportunity for the elite to frustrate the heirs from getting justice, forcing them into consent, through the abuse of the Islamic law of Diyah (Retaliation). Shahzeb’s father, DSP Aurangzeb, died whilst remembering his son.

 

If there was a system of Islam today, in the court of the Qadi Aam, Shah Rukh Jatoi would have imposed Qisas on conviction, within a few hearings. The heirs who did not consent, would not be pressured. They would not have been compelled to grant consent out of frustration. Democracy’s British judiciary can never provide justice, because, in this system, the powerful people make laws in their own interests, by hijacking the parliament. However, the first Khaleefah (Caliph) of Muslims, Abu Bakr Siddique, started the Khilafah with this statement,

ألا إن أقواکم عندي الضعیف حتی آخذ الحق له وأضعفکم عندي القوي حتی آخذ الحق منه

“The weak among you is deemed strong by me, until I return to them that which is rightfully theirs. And the strong among you is deemed weak by me until I take from them what is rightfully someone else’s.” (Al-Badaiya Wal-Nahiya, Tabari, Ibn Hisham)

 

O Sincere Military Officers in the Armed Forces of Pakistan!

Be it the secular democratic government system of Pakistan, the capitalist economic system, the British judiciary based on common law or the secular education system, everything has collapsed. Although the social system has survived to some extent due to the Islamic values within Muslims, that too is under threat due to liberal policies. The foreign policy based on slavery to the international order has turned Pakistan into a failed state. All this happened despite the fact that we are a nuclear power, with a youthful population of 220 million and abundant resources, blessed with the Deen of Islam. So mobilize and start Khilafah from Pakistan. Reject the nation-state order and slavery to the international order, made by the West. The government and the opposition political parties have no solution to the problems of Pakistan. It is only Hizb ut Tahrir which is in front of you, fully prepared and capable of initiating a revolutionary change, within hours. So come forth and grant the Nussrah for the re-establishment of the Khilafah on the Method of Prophethood. The Messenger of Allah (saw) said,

«وَمَنْ مَاتَ وَلَیْسَ فِی عُنُقِهِ بَیْعَةٌ مَاتَ مِیتَةً جَاهِلِیَّةً»

“And whoever dies without the allegiance (of the Khaleefah) around his neck, then he dies the death of Jahiliyyah.”(Muslim)

شاہ زیب قتل کیس کا فیصلہ پاکستان کےنظام عدل ڈھیر ہونے کی باقاعدہ تصدیق ہے جس کا حل صرف خلافت کا شرعی عدالتی نظام ہے

18 اکتوبر کو سپریم کورٹ کے تین رکنی بنچ نےمشہور زمانہ  شاہ زیب قتل کیس میں ملزم شاہ رخ جتوئی کو قتل کے الزام سے بری کر دیا۔ اگرچہ اس فیصلے سے عوام میں شدید غم و غصہ پھیلا تاہم عوام کیلئے یہ غیر متوقع ہرگز نہ تھا۔ وہ اس سے قبل ناظم جوکھیو ، ریمنڈ ڈیوس، عبد المجید اچکزئی کیسز سمیت درجنوں ایسے فیصلوں کا مشاہدہ کر چکے ہیں جہاں عدالتوں نے استعمار اور دیگر طاقتور لوگوں کو مختلف قانونی موشگافیوں کے ذریعے بچنے کا راستہ دیا ، حتیٰ کہ اس کیلئے اسلامی احکامات کو توڑ مروڑ کر استعمال کرنے سے بھی دریغ نہیں کیاگیا۔  شاہ زیب قتل کیس سے ایک بار پھر ثابت ہو گیا ہے کہ اس نظام کی رستی، ٹپکتی چھت زمین بوس ہو چکی ہے ، ریاست پاکستان اشرافیہ کی ریاست بن چکا ہے ، جس میں عام لوگوں کا کوئی حصہ نہیں، اور وقت آ گیا ہے کہ اس بوسیدہ کھنڈر کو گرا کر اس کی جگہ اسلام کی مضبوط بنیاد پر ریاست خلافت قائم کی جائے!

شاہ زیب قتل کیس میں ہرمرحلے پر پوری ریاستی مشینری ملزم کو بچانے میں لگی رہی۔  کیس درج کرنےمیں روڑے اٹکانے، ملزم کوگرفتار نہ کرنے ، ملک سے بھگانے ، جیل کو فائیو سٹار ہوٹل بنانے ، “ہسپتال” میں بھرپور سہولیات دینے، جبری راضی ناموں  اورسپریم کورٹ کا دہشت گردی کی دفعات کی بنیادپر اولاًراضی نامہ مسترد کرنے  اور بعد میں راضی نامہ قبول کرنے تک ہر درجے پر ثابت ہو گیا کہ پاکستان کا نظام عدل ڈھیر ہو چکا ہے۔ تین مرحلہ وار عدالتی اپیل کا نظام طاقتور لوگوں کو وقت، راستہ اور سہولت مہیا کرتا ہے کہ وہ انصاف کا کھلواڑ کر سکے۔ اپیل سسٹم کے ذریعے سزائے موت کو اولاً عمر قید اور آخر کار بریت میں تبدیل کر دیا جاتا ہے جیساکہ اس کیس میں ہوا۔ دس سال کا طویل عرصہ طاقتور طبقے کو موقع مہیا کرتا ہے کہ وہ  ورثا کو  عدل ملنے سے مایوس کرکے انھیں راضی نامے پر مجبور، اور اسلام کے دیت کے احکامات کا غلط استعمال کر سکیں۔ شاہ زیب کا والدڈی ایس پی اورنگزیب اپنے بیٹے کی یاد میں انتقال کر گیا۔

اگر آج اسلام کا نظام ہوتا تو قاضی عام کی عدالت شاہ رخ جتوئی پرچند پیشیوں میں  جرم ثابت ہونے پر قصاص نافذ کر چکی ہوتی ،  کیونکہ دیت قبول نہ کرنے والے ورثا کو نہ تو دباؤ میں ڈالنے کی اجازت ہوتی ، نہ ہی وہ عدل سے مایوس ہو کر راضی نامے پر مجبور ہوتے۔ جمہوریت  اور انگریز کا عدالتی نظام کبھی بھی انصاف مہیا نہیں کر سکتا کیونکہ اس نظام میں طاقتور لوگ پارلیمنٹ کو  ہی ہائی جیک کر کے اپنے مفاد میں قوانین بناتے ہیں۔جبکہ مسلمانوں کے پہلے خلیفہ ابوبکر صدیق نے خلافت کا آغاز اس ارشاد سے کیا تھا ،

﴿ألا إن أقواکم عندي الضعیف حتی آخذ الحق له وأضعفکم عندي القوي حتی آخذ الحق منه﴾

“تم میں سے کمزور ترین آدمی میرے نزدیک طاقتور ہے جب تک کہ میں اس کا حق دلوا نہ دوں اور تم میں سے قوی ترین شخص  میرے نزدیک کمزور تر ہے جب تک میں دوسروں کا حق اس سے حاصل نہ کرلوں“۔ (البدایہ والنہایہ، طبری، ابن ہشام)

         اے افواج پاکستان میں موجود مخلص فوجی افسران !

پاکستان کا سیکولر جمہوری حکومتی نظام ہویاسرمایہ دارانہ  معاشی نظام، کامن لاء پر مبنی انگریزی عدالتی نظام ہو یا سیکولر تعلیمی سسٹم، سب کچھ گر چکا ہے۔اور اگرچہ  مسلمانوں کے اندر موجود اسلامی اقدار کے باعث معاشرتی نظام کچھ حد تک بچا ہوا ہے ،لیکن وہ بھی لبرل پالیسیوں کے باعث خطرے میں ہے۔ انٹرنیشنل آرڈر کی غلامی پر مبنی خارجہ پالیسی  نے پاکستان کو ایک ناکام ریاست میں تبدیل کر دیا ہے ۔ اور یہ سب اس کے  باوجود کہ ہم 22 کروڑ کی اکثریتی نوجوان آبادی اور وسائل سے مالا مال ایک ایٹمی قوت ہیں جو اسلام  کی آفاقی آئیڈیالوجی کے وارث ہیں۔ پس آگے بڑھو اور مغرب کے ترتیب کردہ قومی ریاستی نظام اور انٹرنیشنل آرڈر کی غلامی کو مسترد کر کے پاکستان سے خلافت کا آغاز کرو۔حکومت اور اپوزیشن سیاسی جماعتوں کے پاس پاکستان کے مسائل کا کوئی حل موجود نہیں۔ یہ صرف حزب التحریر ہے جو مکمل تیاری کے ساتھ آپ کے سامنے موجود ہے اور چند گھنٹوں  میں انقلابی تبدیلی کا آغاز کرنے کی صلاحیت رکھتی ہے ۔ پس آگے بڑھو اور خلافت کے قیام کے لئے نصرہ دو۔

 مَنْ مَاتَ وَلَیْسَ فِی عُنُقِهِ بَیْعَةٌ مَاتَ مِیتَةً جَاهِلِیَّةً

“۔اور جو کوئی اس حال میں مرا کہ اس کی گردن میں (خلیفہ کی) بیعت کا طوق نہیں، تو وہ جاہلیت کی موت مرا۔”(صحیح مسلم)
