Whether Presidential or Parliamentary, Democracy Grants Sovereignty
and Unjust Privilege to the Power Elite
It is naive to expect Democracy to guarantee justice, denying unjust privilege to power elites, when its essence is compromise. The release from prison of convicted former Prime Minister, Nawaz Sharif, whilst granting him permission to fly abroad for treatment, is a clear case of Democracy’s protection of the power elite. Any who naively believed the rulers’ loud claims of “no NRO (National Reconciliation Ordinance)” for the corrupt power elite, can now feel the sting of their folly. Thus, Democracy grants the corrupt power elite get-out-of-jail-free cards, whilst many common prisoners die in jail through illness, some just awaiting trial without any conviction for years. Unlike the power elite, they never have their case disposed of within a single day, let alone being granted the privilege of treatment abroad, with a flimsy, loop-hole ridden, paper promise to return.
Democracy is founded on compromise of principle and truth. European intellectuals who denied the existence of God and the authority of the Church, were granted the compromise deal of limiting religion to places of worship, without ever settling the fundamental matter of the existence of a Creator. Through compromise, the sovereignty of God’s law was thus transferred to power elite, who hid behind exercising sovereignty in the name of the masses. Whether Presidential or Parliamentary, Democracy now ensures power, privilege and wealth progressively concentrate within an elite ruling group, which fools the ruled with the lollipops of equality and representation of the masses. Democracy grants privilege to the power elite and Pakistan’s history is littered with examples, such as the 17th and 21st constitutional amendments, the National Reconciliation Ordinance (NRO), immunity for the President, Prime Minister and governors and privilege motions for the members of the assemblies. Above all, public representatives wield the power to declare any action as legal or illegal, thus allowing usury, taxing of the poor and allying with enemy states, compromising state security, whilst fighting foreign wars for dollars.
Like its democratic predecessors, the Bajwa-Imran regime has granted privilege to the corrupt, having granted outrageous privileges and crushing concessions to both Trump and Modi. Democracy is a system of compromise, which bends before the powerful and tramples on the weak. In Islam’s ruling system, the Khilafah, far from being sovereign and thus privileged, all the rulers and representatives are subject to the commands of Allah (swt) and His Messenger (saaw). RasulAllah (saaw) said,
وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا
“By Allah, if Fatima, daughter of Muhammad, were to steal, I would have her hand cut off.” (Muslim).
Thus, when the Khaleefah Rashid, Umar (r.a), limited the dowry to reduce the burdens of marriage, he took his decision back when a woman reminded him that Allah (swt) had not limited the dowry. Thus, the Khaleefah Rashid, Ali (r.a), lost a case against a Jewish citizen, accused of stealing Ali’s (r.a) armor, through Islam’s rejection of the admission of the witness of the son in the case of the father. Thus, the son of Amr ibn al-Aas (r.a), the Khilafah’s governor of Egypt, was punished with lashes upon the complaint of a non-Muslim citizen. Throughout the thirteen centuries of the Khilafah, the Islamic judiciary was a beacon of justice through its ruling by all that Allah (swt) has revealed. In the Khilafah, neither the elected Khaleefah nor elected members of the Majlis ul-Ummah, can change a single Hukm (Ruling) of Allah (swt). In the Khilafah, the Judge of Unjust Acts (Qadhi Madhalim) can reverse the decision of the Khaleefah, if it is not derived from the Quran and Sunnah. Clearly only the Khilafah (Caliphate) on the Method of Prophethood can end privilege for the power elite. Allah (swt) said,
يَآ اَيُّـهَا الْاِنْسَانُ مَا غَرَّكَ بِرَبِّكَ الْكَرِيْمِ“
O mankind, what has deceived you concerning your Lord, the Generous” (Surah Al-Infitar 82:6).

پارلیمانی ہو یا صدارتی ، دو ٹکے کا یہ نظام حسب عادت اشرافیہ کو این آر او دیتا رہے گا
جس جمہوری نظام کی بنیاد، خمیر اور ڈھانچہ NRO پر بنا ہو ، اس میں انصاف کی ضمانت، برابری اور NRO نہ دینےکا دعویٰ کرنا رتی برابر عقل سے بھی خالی ہونے کے مترادف ہے۔ اگرچہ فہم و شعور والےلوگ تو پہلے سے ہی اس تبدیلی کے ڈھکوسلے سے واقف تھے، یا جلد ہی جان گئے تھے، لیکن تاحال تبدیلی لگانے کی امید لگانے والوں کے سامنے کل NRO نہ دینے کا دعویٰ کرنے والا یہ نظام مکمل بے نقاب ہو گیا۔ جو اشرافیہ (Elite class) کو علاج کیلئے سزا ہونے کے بعدبھی ضمانت دے کر بیرون ملک بھیجتا ہے لیکن صرف شک کی بنیاد پر مقدمے بھگتتے سینکڑوں حوالاتی قیدی بیماری کے باعث جیل میں انتقال کر جاتے ہیں لیکن ان کیلئے ایک دن کے نوٹس پر ہائی کورٹ کی سماعت مقرر کی جاتی ہے اور نہ انھیں ایسی کوئی بیرون ملک علاج کی اجازت ملتی ہے۔
جمہوریت کی بنیاد ہی ایک کمپرومائز تھا جب اللہ کی ذات کےانکار پر اصرارکئے بغیر مفکرین اور چرچ کے درمیان رب کو مسجد، مندر اور چرچ کا ”قیدی “بنانے کی NRO ڈیل ہوئی۔ اور خودمختاری رب سے ”چھین“ کر عوام کے نام پر اشرافیہ کو دے دی گئی۔ اس وقت سے آج تک ہر گزرتے دن کے ساتھ اشرافیہ عوام کو چند حقوق کا لالی پاپ دے کر تمام وسائل پر اپنی گرفت مضبوط کرتی جا رہی ہے۔ پارلیمانی نظام ہو یا صدارتی، قوانین بنانے کی فیکٹری عوامی نمائندوں کے نام پر اشرافیہ کے پاس ہی رہتی ہے۔ دعوٰ ی تویہ کیا جاتا ہے کہ جمہوریت میں سب لوگ برابر ہوتے ہیں لیکن درحقیقت اشرافیہ دوسرے سے” زیادہ برابر “ ہوتے ہیں۔ 17ویں ترمیم ہو یا اکیسویں، NRO کا قانون ہو یا صدر، وزیراعظم اور گورنروں کامختلف قوانین سے استثناء، ارکان اسمبلی کے استحقاق ہو یا اعلیٰ عدلیہ کے احتساب کیلئے حد درجہ پیچیدہ طریقہ کار، یا اپنی مرضی سے کچھ ایکشن کو جرائم اور کچھ کو قانونی قرار دیں، اور یوں سود، غریب عوام پر ٹیکس، حربی کافروں سے الائنس، ملکی سالمیت پر کمپرومائز، ڈالروں کے عوض امریکی جنگیں لڑنا، سب قانوناً جرائم نہیں، لیکن غیر شرعی ٹیکس کی ریٹرن جمع نہ کرانا جرم قرار دیا جاتا ہے، یوں یہ نظام ہر قدم پر NRO کرتا چلا جا رہا ہے۔
باجوہ-عمران حکومت، اپنے پیشروں کی مانند ٹرمپ اور مودی کو NRO دینے کے بعد اشرافیہ کو NRO دینے کی اسی روش پر چل رہے ہیں، جو جمہوریت کا خاصہ ہے۔ یہ بلیک میلنگ کا وہ نظام ہے جو طاقتور کے سامنے جھکتا اور کمزور کو پیس کر رکھ دیتا ہے۔یہ خلافت کا نظام ہی تھا جس میں شرع کی حاکمیت تھی جس کے باعث خلیفہ راشد حضرت علی رض اپنے زرہ کی چوری کا مقدمہ ایک یہودی شہری سے عدم ثبوت کی بنا پر ہار جاتے ہیں، گورنر مصر عمر بن العاص رض کے بیٹے کو کوڑے لگتے ہیں۔یہ وہ نظام ہے جس میں آپ ﷺنے اصول طے کر لیا ہے کہ
”وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا“
” اللہ کی قسم اگر میری بیٹی فاطمہ بھی چوری کرتی تو میں اس کا بھی ہاتھ کاٹ دیتا“ (صحیح مسلم)۔
اور تیرہ سو سال کی اسلامی تاریخ میں ایسا کوئی ایک بھی جانا مانا واقع موجود نہیں کہ جب قاضی نے اللہ کی شرع کو چھوڑ کر اشرافیہ کو نوازنے کیلئے اللہ کے احکامات سے پہلوتہی کی ہو۔ یہ خلافت ہی ہے جس میں مجلس امت ہو یا خلیفہ ، کوئی بھی ایک بھی شرعی حکم کو نہیں بدل سکتا۔ یہاں تک کہ جب عمر رض نے نیک نیتی سے شادیاں آسان بنانے کیلئے مہر کی کم رقم فکس کرنی چاہی، تو ایک خاتون شہری نے مسجد میں اٹھ کو ان کا احتساب کرتے ہوئے کہا کہ جو حق ہمیں اللہ نے دیا ہے ان پر آپ کیسے قدغن لگا سکتے ہیں؟ جس پر انھیں اپنی پالیسی کو بدلنا پڑا۔ خلیفہ کے کسی غیر شرعی عمل پر قاضی مظالم کی عدالت اس کا فیصلہ معطل کر سکتی ہے۔ جمہوریت اور آمریتوں کا گھن چکر سب کے سامنے بےنقاب ہے۔ اللہ کی وحی پر مبنی نظام خلافت ہی تمہیں استعمار اور اس کے ایجنٹ اشرافیہ کی چنگل سے نجات دلائے گا۔ اللہ سبحانہ و تعالیٰ نے قرآن میں فرمایا؛
”يَآ اَيُّـهَا الْاِنْسَانُ مَا غَرَّكَ بِرَبِّكَ الْكَرِيْمِ“
”تواے بنی آدم، تمھیں کس نے اپنے کریم رب سے دھوکے میں ڈال رکھا ہے“(سورہ الانفطار: 6) ۔
