Writ petition against illegal banning of Hizb ut-Tahrir stalled for six years

Is the meaning of independent judiciary to facilitate the tyrant rulers’ oppression?

Hizb ut-Tahrir is the world’s largest Islamic political party, working in over forty countries to resume the Islamic way of life, through the implementation of Khilafah. Because the Hizb wants to uproot the Kufr capitalist system within the Muslim countries and establish Khilafah Rashida, the colonialists, in particular America and Britain, bans Hizb ut-Tahrir in the Muslim countries through their agents. In Pakistan, the American agent Musharraf banned Hizb ut-Tahrir in 2003 on the directives of America, failing to present any justification to do so. It is because of this fact that an anti terrorist court in Karachi, which was established by Musharraf, disposed of a fabricated case against the peaceful members of Hizb and wrote in its decision that government has not mentioned any reason for banning Hizb ut-Tahrir, and so this banning is “Defective”. The regime does not have a single shred of legal or Shar’i evidence to support its action, because Hizb ut-Tahrir considers it haram (forbidden) to take up arms in order to establish the Khilafah. This is why government has been using delay tactics during court proceedings for the last six years. But the high court is allowing the government to continue its oppression by giving lengthy dates consistently, instead of issuing an order to lift the ban on Hizb ut-Tahrir on the grounds that no evidence has been provided by the government. This pretext, that it is a banned organization, has been used by the government to arrest its members for the last six years. We are not allowed to do any peaceful demonstration or public gathering. Our members are abducted by government agencies without any reason and then they are tortured and then abandoned in deserted places. Until now, the government agencies have abducted a respected member of Hizb ut-Tahrir from Rahim Yar Khan, Dr. Abdul Qayyum, for the last six months at their torture cell. The traitor rulers and the so-called “Independent Judiciary” are responsible of all these acts of hostility, with the judiciary providing legal cover to these American agents.

Tomorrow the hearing of the Hizb ut-Tahrir ban case. It has yet to be seen whether this time again the judiciary takes the side of the government, as it has been taking for the last six years or whether they will become fearful of Allah SWT and His Messenger SAW and lift the ban from Hizb ut-Tahrir. We appeal to the sincere people present in the lawyer’s community and human rights organizations to raise their voice against this oppression. We declare to tell the government that Hizb ut-Tahrir has been facing hostilities and aggression throughout the world for the last sixty years and arrests and banning has never been able to divert Hizb from its goal of establishing Khilafah. No doubt the promise of Mohammad SAW will be proved and Khilafah will be established tomorrow if not to day.

حزب التحریر پر غیر قانونی پابندی کے خلاف رِٹ چھ سال سے التوا کا شکار!

کیا “آزاد عدلیہ” کا مطلب حکومت کو ظلم و جبر کرنے کی “آزادی” فراہم کرنا ہے؟

حزب التحریر دنیا کی سب سے بڑی اسلامی سیاسی جماعت ہے جو چالیس سے زائد ممالک میں خلافت راشدہ قائم کر کے اسلامی طرز زندگی کے ازسرنو آغاز کے لئے کوشاں ہے۔ حزب چونکہ سرمایہ دارانہ کفریہ نظام کو مسلم ممالک سے اکھاڑ کرخلافت راشدہ کا قیام چاہتی ہے اسی لئے استعمار خصوصاً امریکہ اور برطانیہ حزب التحریر پر ہر مسلم ملک میں اپنے ایجنٹوں کے ذریعے پابندی لگاتے ہیں۔ پاکستان میں امریکہ کے پٹھو، مشرف نے امریکہ کے حکم پرحزب التحریرپر 2003 میں پابندی لگائی۔ اس کے لئے اس نے کسی قسم کی کوئی توجیح پیش کرنا بھی ضروری نہ سمجھا۔ اسی لئے خود مشرف کی قائم کردہ کراچی کی دہشت گردی کی عدالت نے حزب کے پر امن ممبران کے خلاف جھوٹا کیس خارج کر دیا اور اپنے فیصلے میں تحریر کیا کہ چونکہ حکومت نے حزب التحریر پر پابندی لگانے کی کوئی وجہ بیان نہیں کی اس لئے یہ پابندی “ناقص” (Defective) ہے۔ اس غیر قانونی اور غیر شرعی پابندی کے حق میں حکومت کے پاس رائی برابر بھی ثبوت نہیں کیونکہ حزب التحریر خلافت کے قیام میں عسکری جدوجہد کو جائز نہیں سمجھتی۔ یہی وجہ ہے کہ حکومت چھ سال سے عدالتی کاروائی کے دوران پس و پیش سے کام لے رہی ہے اور پاکستان کی “آزاد عدالتیں” انہیں ایسا کرنے میں مدد فراہم کر رہی ہیں۔ بجائے اس کے کہ ہائی کورٹ حکومت سے حزب التحریر کے خلاف ثبوت مانگے اور عدم ثبوت کی بنا پر حزب التحریر پر عائد پابندی ختم کر دے، وہ لمبی لمبی تاریخیں دے کر حکومت کو اپنا ظلم و جبر جاری رکھنے کی اجازت دے رہی ہے۔ اسی وجہ سے گزشتہ چھ سالوں کے دوران محض یہ توجیح پیش کر کے کہ حزب ایک کالعدم جماعت ہے، حکومت سینکڑوں کارکنوں کو گرفتار کر چکی ہے۔ ہمیں کسی بھی قسم کا پرامن مظاہرہ یا جلسہ کرنے کی اجازت نہیں دی جاتی۔ ہمارے ممبران کو بغیر کسی وجہ حکومتی ایجنسیاں اغوا کر لیتی ہیں اور پھر شدید تشدد کر کے انہیں کسی ویرانے میں پھینک دیتی ہیں۔ آج بھی حزب التحریرکے رکن اور رحیم یارخان کے معزز ڈاکٹر جناب عبدالقیوم کو ایجنسیاں پچھلے چھ ماہ سے اپنے عقوبت خانوں میں ٹارچر کا نشانہ بنا رہی ہیں۔ ان تمام ظالمانہ کاروائیوں کے ذمہ دار یہ غدار حکمران اور یہ “آزاد عدلیہ” ہے جو ان امریکہ کے ایجنٹوں کو قانونی تحفظ فراہم کر رہی ہے۔

کل پھر حزب التحریرکی تاریخ ِسماعت ہے۔ دیکھنا یہ ہے کہ کیا گزشتہ چھ سالوں کی طرح آج بھی عدلیہ حکومت کا ساتھ دیتی ہے یا اللہ اور رسول ﷺ کا خوف غالب آتا ہے اورحزب التحریر پر عائد پابندی کا خاتمہ کیا جاتا ہے۔ ہم وکلاء برادری اور انسانی حقوق کی تنظیموں میں موجود مخلص لوگوں سے مطالبہ کرتے ہیں کہ وہ اس ظلم کے خلاف آواز بلند کریں۔ ہم حکومت کو بھی بتا دینا چاہتے ہیں کہ حزب التحریر گزشتہ ساٹھ سالوں کے دوران پوری دنیا میں جبر و ظلم برداشت کرتی چلی آئی ہے اور پابندیاں اور گرفتاریاں خلافت کے ہدف سے حزب کو دور نہیں کر سکتیں۔ بے شک رسول اللہ  کا وعدہ سچ ثابت ہو کر رہیگا اور خلافت آج نہیں تو کل ضرور قائم ہو کر رہے گی۔
